Read the Terms of Use for VIKL.

1. Purpose

These Terms of Use (TOU) govern access to and use of the VIKL platform (hereinafter "the Platform"), accessible via the website vikl.ai and the web application vikl.app. By accessing and using the Platform, you unconditionally accept these TOU. If you do not accept these terms, please do not use the Platform.

2. Definitions

"User": any natural person accessing and using the Platform.
"Account": personal space created by the User on the Platform.
"Service": all features offered by VIKL (AI coaching, exercises, etc.).
"Content": any element (text, image, video, data) present on or submitted to the Platform.

3. Registration and user account

3.1. Account creation

To access certain features of the Platform, you must create an account by providing accurate, complete and up-to-date information. You are responsible for the confidentiality of your login credentials and for all activities carried out from your account.

3.2. Registration requirements

Be at least 18 years of age and have the legal capacity to enter into contracts.
Provide accurate and truthful information when creating your account.
Not create multiple accounts for the same service.

3.3. Account security

You must notify us immediately of any unauthorised use of your account or any security breach. VIKL is not responsible for any damage resulting from unauthorised use of your account due to your own negligence.

4. Description of services

VIKL offers an AI-assisted coaching platform for managing micro-conflicts and developing interpersonal skills in the workplace. Services include in particular:

AI-guided coaching for micro-conflict resolution.
Practical feedback exercises.
Personalised recommendations (AI).
Team health indicators (for company accounts).
Educational resources and guides.

5. Use of the platform

5.1. Authorised use

You undertake to use the Platform in a lawful manner consistent with these TOU, as well as with applicable laws and regulations.

5.2. Prohibited activities

The following are strictly prohibited:

Using the Platform for illegal or unauthorised purposes.
Attempting to gain unauthorised access to VIKL's systems or networks.
Distributing viruses, malware or any malicious code.
Harassing, threatening or intimidating other users.
Publishing offensive, discriminatory or inappropriate content.
Collecting information about other users without their consent.
Using the Platform for spam or unsolicited commercial communications.
Copying, modifying or distributing Platform content without authorisation.
Attempting to reverse engineer or decompile the Platform's software.

6. Artificial intelligence and limitations

The VIKL platform uses artificial intelligence to provide personalised recommendations and support. Important limitations:

VIKL does not replace a mental health professional, therapist or qualified mediator.
AI recommendations are generated automatically and may contain inaccuracies.
VIKL is not responsible for decisions made on the basis of the recommendations provided.
In the event of a serious situation, crisis or distress, please immediately consult a qualified professional.

7. Intellectual property

All intellectual property rights relating to the Platform and its content (texts, graphics, logos, icons, images, audio clips, data compilations, software, etc.) are the exclusive property of VIKL or its licensors. You may not reproduce, distribute, modify, create derivative works from, display or exploit the content in any way without the prior written authorisation of VIKL.

8. User content

You retain all rights over the content you submit to the Platform (texts, comments, etc.). By submitting content, you grant VIKL a worldwide, non-exclusive, royalty-free licence to use, reproduce and analyse such content for the purpose of providing and improving our services. You warrant that your content does not infringe any third-party rights and does not contain any illegal, defamatory or offensive material.

9. Privacy

The confidentiality of your data is paramount to VIKL. Conversations with the AI are encrypted and are not accessible by administrators or other users. For more information, please consult our Privacy Policy.

10. Service availability

VIKL endeavours to ensure the continuous availability of the Platform but cannot guarantee uninterrupted access. We reserve the right to temporarily suspend access for maintenance, updates or any other technical reason (notified in advance wherever possible).

11. Modification and suspension of service

VIKL reserves the right to modify, suspend or discontinue all or part of the Platform at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension or interruption of the service.

12. Termination

You may terminate your account at any time by contacting us or from your account settings. VIKL may immediately suspend or terminate your account, without notice, in the event of a breach of these TOU (in particular, fraudulent or abusive use). Upon termination, your access to the services will be removed and your data will be processed in accordance with our Privacy Policy.

13. Limitation of liability

To the extent permitted by law:

VIKL does not warrant that the Platform will be free from errors, bugs or outages.
VIKL is not responsible for indirect, incidental or consequential damages (including loss of data or profits).
VIKL cannot be held liable for advice or recommendations provided by the AI, nor for the decisions you make based on them.
VIKL's total liability to a User is limited to the amount actually paid by that User over the preceding 12 months.
